Welcome to Before Memory Fades.
Before Memory Fades is an initiative of Kunashni Foundation and provides an online space where people can preserve and share the stories, photographs and memories of animals who have touched their lives.
These Terms & Conditions govern your use of the Before Memory Fades website and its services.
By creating an account, creating a Memorial, submitting content, sharing a memory, or otherwise using Before Memory Fades, you agree to these Terms & Conditions and acknowledge our Privacy Policy.
- ABOUT BEFORE MEMORY FADES
Before Memory Fades provides a platform through which users can create Memorials for animals they wish to remember.
A user may create more than one Memorial. Memorials associated with a user’s account may together form that user’s Memory Garden.
Before Memory Fades may also allow visitors to share memories or remembrances on Memorials created by others.
The service may change and develop over time, and additional features may be introduced in the future.
- YOUR ACCOUNT
Certain features of Before Memory Fades require you to create an account.
You are responsible for:
- providing accurate information when creating your account;
- keeping your login details and password confidential;
- activities carried out through your account; and
- informing us if you believe your account has been accessed or used without your permission.
You should use a strong password and should not knowingly allow another person to misuse your account.
Before Memory Fades may restrict, suspend or close an account where reasonably necessary to protect the website, its users, its content or the rights of others.
- CREATING A MEMORIAL
When creating a Memorial, you may provide information such as the animal’s name, photographs, details about their life, your relationship with them, places or dates associated with them, and stories or memories you wish to preserve.
You are responsible for deciding what information you wish to include.
Please take particular care before including personal information about another person or photographs in which people can be identified.
- MEMORIALS ARE PUBLIC
Published Memorials on Before Memory Fades are currently public.
This means that a published Memorial, including its photographs, stories and other information, may be viewed by anyone who visits the website.
Published Memorials may also be accessible through the public Memorial collection, search engines, direct links, WhatsApp, social media and other websites or services.
Please do not publish information that you do not wish to make publicly available.
Before Memory Fades may introduce additional privacy or visibility options in the future.
- MEMORY GARDENS
Memorials associated with a user’s account may form that user’s Memory Garden.
Public Memory Gardens may be accessible to visitors and may be shared through direct links, WhatsApp or other services.
A Public Memory Garden may display the user’s first name and links to their published Memorials.
Before Memory Fades may introduce additional Memory Garden privacy or visibility options in the future.
- YOUR CONTENT
You retain ownership of the photographs, stories, memories and other original content that you submit to Before Memory Fades, subject to any rights belonging to other people.
By submitting or publishing content through Before Memory Fades, you give Kunashni Foundation and Before Memory Fades permission to host, store, reproduce, display and technically process that content as reasonably necessary to operate, maintain, back up and provide the Before Memory Fades service.
This permission allows us, for example, to display your photographs on a Memorial, generate appropriately sized versions of uploaded images, display a Memorial within a Memory Garden, create website backups, and make published Memorials available to visitors.
This permission does not transfer ownership of your original content to Before Memory Fades or Kunashni Foundation.
- YOUR RESPONSIBILITY FOR CONTENT
You should only upload or publish content that you have the right or permission to use.
By submitting content, you confirm that, to the best of your knowledge, you are entitled to submit and publish it through Before Memory Fades.
You must not knowingly upload or publish content that:
- infringes another person’s copyright, privacy or other legal rights;
- contains unlawful material;
- is threatening, abusive or intended to harass another person;
- contains malicious software or harmful code;
- is deliberately false or misleading in a way that may cause harm;
- contains advertising, spam or unrelated commercial promotion; or
- is otherwise inappropriate for a remembrance platform.
If another person has rights in a photograph or other material, you are responsible for obtaining any permission reasonably required before uploading it.
- MEMORIES SHARED BY VISITORS
Before Memory Fades may allow visitors to contribute memories or remembrances to a Memorial.
Submitted memories may be held for moderation before being displayed publicly.
The person submitting a memory is responsible for the content they submit.
A Memorial owner may be given tools to approve or remove memories submitted to their Memorial.
Before Memory Fades may also remove or restrict submitted memories where reasonably necessary, including where content is abusive, unlawful, spam, unrelated, infringes another person’s rights, or is otherwise inappropriate for the service.
- MODERATION AND REMOVAL OF CONTENT
Before Memory Fades is intended to be a respectful remembrance space.
We reserve the right to review, restrict or remove content where we reasonably believe it:
- violates these Terms & Conditions;
- violates applicable law;
- infringes another person’s rights;
- contains spam or malicious material;
- is abusive, threatening or seriously inappropriate;
- creates a security risk; or
- materially interferes with the operation or purpose of the service.
Where appropriate, we may contact the account holder before taking action, but we may act without prior notice where reasonably necessary to protect users, third parties or the service.
- REPORTING A CONCERN
If you believe that a Memorial, photograph, shared memory or other content infringes your rights or should not appear on Before Memory Fades, please contact us at:

We will review reasonable requests and may contact you for additional information where necessary.
- SHARING MEMORIALS
Before Memory Fades is designed to allow Memorials and Memory Gardens to be shared.
The website may provide tools for sharing links through services such as WhatsApp or for copying a Memorial or Memory Garden web address.
Once publicly available content has been shared outside Before Memory Fades, we cannot control copies, screenshots, messages, links or other uses made by third parties.
Third-party websites and services operate according to their own terms and privacy practices.
- PRESERVATION OF MEMORIALS
The purpose of Before Memory Fades is to help preserve memories over time.
We therefore intend for published Memorials to remain available for the long term, subject to these Terms & Conditions, the operation of the service, account-holder requests and applicable legal requirements.
However, no online service can guarantee that particular content or a service will remain available indefinitely.
Users should therefore retain their own copies of photographs and other important original material.
Before Memory Fades should not be treated as the sole backup or permanent archive of irreplaceable photographs or documents.
- DELETING OR CLOSING AN ACCOUNT
You may contact us if you wish to close your account or request removal of content associated with it.
Because an account may contain multiple Memorials and memories, we may need to verify your identity and clarify what should happen to associated content before processing certain requests.
Closing an account will not necessarily result in the immediate removal of every technical copy of information from backups, security records or systems where temporary retention is reasonably necessary.
We may also retain information where required by law or reasonably necessary for security, dispute resolution or protection of legal rights.
- MEMBERSHIP AND PAID SERVICES
Before Memory Fades may introduce paid memberships, subscriptions or other paid services in the future.
If paid services are introduced, the applicable price, duration, renewal arrangements and important conditions will be shown before a user purchases the service.
Payments may be processed through a third-party payment provider and may also be subject to that provider’s terms and privacy practices.
Additional payment, cancellation, renewal or refund terms may be introduced when paid services become available.
The introduction of paid services will not automatically alter these Terms & Conditions without appropriate notice or an updated version being published.
- SERVICE AVAILABILITY
We aim to keep Before Memory Fades available and functioning reliably.
However, the website may occasionally be unavailable because of maintenance, upgrades, technical failures, security incidents, hosting issues or circumstances outside our reasonable control.
We do not guarantee uninterrupted or error-free access to the service.
We may modify, improve, replace or discontinue particular features as Before Memory Fades develops.
- THIRD-PARTY SERVICES AND LINKS
Before Memory Fades may use or link to third-party services, including hosting providers, email services, payment providers, social-sharing services or other websites.
We are not responsible for the availability, content, security, terms or privacy practices of independently operated third-party services.

However, no internet-based service can guarantee absolute security.
Users are responsible for taking reasonable precautions to protect their own account credentials and devices.
- LIMITATION OF RESPONSIBILITY
Before Memory Fades is provided as an online remembrance and memory-preservation service.
To the extent permitted by applicable law, Kunashni Foundation and Before Memory Fades are not responsible for losses resulting from circumstances outside our reasonable control, third-party services, unauthorised use of an account where reasonable security measures have been provided, or content submitted or shared by users or visitors.
Nothing in these Terms & Conditions is intended to exclude or limit any responsibility that cannot legally be excluded or limited under applicable law.
- CHANGES TO THE SERVICE OR THESE TERMS
Before Memory Fades is an evolving service.
We may update these Terms & Conditions when the website, its features, membership arrangements or applicable requirements change.
When we make material changes, we may provide notice through the website or by another appropriate method.
The latest version of these Terms & Conditions will be published on this page with its updated date.

- GOVERNING LAW AND JURISDICTION
These Terms & Conditions are governed by the laws applicable in India.
Subject to applicable law, disputes relating to Before Memory Fades or these Terms & Conditions will be subject to the jurisdiction of the appropriate courts in Pune, Maharashtra, India.
